Notice Of Optional Legal Guidance
Dear Ride Share Driver:
The Office of the New York State Attorney General Letitia James (“OAG”) and Held & Hines LLP have entered into an agreement called an Assurance of Discontinuance (“the AOD”) that addresses the terms by which Held & Hines, LLP is permitted to represent you with respect to the OAG settlement with Uber and Lyft. As provided by the AOD, we write to advise you of the following information:
- In November 2023, the OAG secured a settlement of $328 million from Uber and Lyft for illegal deductions of Black Car Fund and New York state sales tax from driver earnings (“the OAG Settlements”).
- If the OAG identifies you as eligible for a settlement payment, you will receive an official claim form from Rust Consulting, the settlement administrator
- The OAG has stated that you do not need an attorney to fill out the claim form and receive settlement funds due to you in an amount determined by the OAG in its sole discretion.
- You can receive free assistance to file a claim by contacting Rust Consulting (for Uber: 1-800-625-2332, https://ubernyagsettlement.com/); for Lyft: 1-800-433-5314); https://lyftnyagsettlement.com/); or the OAG (1-800-771-7755).
- The OAG’s view is that completing the claim form and obtaining appropriate settlement payments (if eligible) will be simple.
- If you would like Held & Hines to represent you for a claim in the OAG Settlements, click HERE [link] for a retainer agreement related to those claims.
- Under that agreement, our sole charge to you for our legal services will be a contingency fee of 15% of the first $1,000 you are to receive, plus 10% of any amount on top of the first $1,000. Our maximum legal fee will be $1,000 for the OAG claim. No other costs or fees will be charged in addition to the contingency fee.
